General Terms and Conditions
(The following General Terms and Conditions also contain statutory information about your rights under the regulations on distance contracts and electronic commerce.)
1. Scope
1.1. These General Terms and Conditions (GTC) apply to all purchase contracts between Limitless eCom GmbH, Warthestraße 21, 14513 Teltow (hereinafter referred to as “Seller”) and the customer (hereinafter referred to as “Customer”) via the Lotus Dream Shop (http://lotusdream.de), regardless of whether the Customer orders goods as a consumer or entrepreneur.
1.2. You can reach our customer service for questions, complaints, and claims on weekdays from 10:00 a.m. to 5:00 p.m. by email at kontakt@lotusdream.de.
1.3. A consumer within the meaning of § 13 BGB is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur within the meaning of § 14 (1) BGB is a natural or legal person or a partnership with legal capacity acting in the exercise of its commercial or independent professional activity.
1.4. Deviating terms of the Customer are not accepted unless the Seller expressly agrees to their validity. These GTC also apply if the Seller delivers to the Customer while aware of conflicting or differing terms of the Customer.
2. Offers and Service Descriptions
2.1. The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. Product descriptions in catalogs or on the Seller’s websites do not constitute guarantees or warranties.
2.2. All offers are valid “while stocks last,” unless otherwise stated for the product.
3. Ordering Process and Conclusion of Contract
3.1. The Customer may select products from the Seller’s range and collect them in a shopping cart using the “Add to Cart” button. The Customer can then proceed to checkout via the “Proceed to Checkout” button.
3.2. By clicking “Order Now,” the Customer submits a binding offer to purchase the goods in the shopping cart. Before submitting the order, the Customer can review and edit all details. Required fields are marked with an asterisk (*).
3.3. The Seller will send the Customer an automatic confirmation of receipt by email, listing the Customer’s order (order confirmation). This confirmation does not constitute acceptance of the offer. The purchase contract is concluded only when the Seller confirms shipment by a separate email or by dispatching the goods.
3.4. If delivery of the ordered goods is not possible (e.g. because the goods are out of stock), the Seller will not issue an acceptance. No contract is formed in this case. The Customer will be informed promptly, and any payments will be refunded immediately.
3.5. The contract language is English.
4. Prices and Shipping Costs
4.1. All prices stated on the Seller’s website include the applicable statutory value-added tax (VAT).
4.2. In addition to the stated prices, the Seller charges shipping costs, which are clearly communicated to the Customer on a separate information page and during checkout. Any customs duties or local taxes are the Customer’s responsibility.
4.3. Goods are shipped by postal delivery. The Seller bears the shipping risk if the Customer is a consumer. If the Customer is an entrepreneur, delivery is made “ex works” (EXW according to Incoterms® 2010), meaning risk transfers to the Customer once the goods are handed over to the carrier.
4.4. In the event of a withdrawal, the Customer must bear the direct cost of returning the goods.

5. Delivery and Availability of Goods
5.1. Delivery times stated by us are calculated from the time of our order confirmation, provided payment has been received in advance.
5.2. If the product is unavailable at the time of order, the Seller will inform the Customer immediately. If the product is permanently unavailable, no contract is formed.
5.3. If the product is temporarily unavailable, the Seller will notify the Customer and may offer a comparable product.
5.4. Delivery is restricted to customers with billing and shipping addresses in Germany and Norway.
5.5. If prepayment is agreed upon, delivery occurs after receipt of payment.
5.6. The Seller may make partial deliveries if reasonable for the Customer; additional shipping costs are borne by the Seller.
5.7. Delivery is made to the shipping address provided by the Customer.
5.8. If delivery fails after three attempts, the Seller may withdraw from the contract. Any payments will be refunded promptly, minus potential damages.
6. Payment Terms
6.1. Unless otherwise agreed, payment is due immediately upon conclusion of the contract.
6.2. The Customer may choose from the available payment methods during checkout:
- Prepayment: The Customer transfers the amount to the Seller’s bank account specified in the order confirmation. Dispatch occurs after receipt of payment.
- PayPal: Payment is processed via PayPal. The Customer must be registered with PayPal and authorize payment. PayPal fees are borne by the Seller.
- Credit Card (VISA, Mastercard): The Customer provides credit card details; shipment follows successful authorization.
- Instant Bank Transfer (Sofortüberweisung): The Customer transfers the amount immediately after ordering; shipment follows payment confirmation.
6.3. The Customer may change their stored payment method in their user account at any time.
6.4. If payment is overdue, interest of 5 percentage points above the base rate per year applies. Additional damages for delay may be claimed.
6.5. The Customer may only offset undisputed or legally established claims.
7. Retention of Title
The Seller retains ownership of the delivered goods until full payment has been received (including VAT and shipping).
8. Warranty and Guarantee
8.1. The Seller is liable for material defects in accordance with statutory provisions (§§ 434 ff. BGB). The limitation period begins upon delivery of the goods. For entrepreneurs, the warranty period is 12 months.
8.2. An additional guarantee applies only if explicitly stated in the order confirmation.
9. Liability
9.1. Claims for damages by the Customer are excluded, except for injury to life, body, or health, or for breaches of essential contractual obligations (cardinal obligations), or for damage caused intentionally or by gross negligence.
9.2. In the event of simple negligence of essential contractual obligations, the Seller’s liability is limited to the foreseeable, typical damage.
9.3. These limitations also apply to the Seller’s legal representatives and vicarious agents.
9.4. The exclusions do not apply in cases of fraudulent concealment of defects, assumed guarantees, or under the Product Liability Act.
10. Storage of the Contract Text
10.1. The Customer may print the contract before placing the order using their browser’s print function.
10.2. The Seller also sends an order confirmation including all order details and a copy of the GTC, withdrawal policy, and shipping/payment information by email.
11. Money-Back Guarantee
If you are not satisfied with the product, you may use your money-back guarantee by contacting kontakt@lotusdream.de.
After agreement, you may return the product. Refunds are only possible if the product is returned complete, clean, and functional in its original packaging.
We may withhold reimbursement until we have received the goods or proof of return.

12. Data Protection
12.1. The Seller processes the Customer’s personal data (e.g. name, address, email, phone number, bank details) in accordance with data protection laws.
12.2. All personal data is treated confidentially and used for processing orders, managing customer relations, delivering goods, processing payments, and preventing defaults. Data may be shared with service providers (e.g. shipping companies or banks).

13. Online Dispute Resolution / Consumer Arbitration
13.1. The European Commission provides an online dispute resolution platform at http://ec.europa.eu/odr.
13.2. The Seller is not obligated and does not voluntarily participate in dispute resolution proceedings before a consumer arbitration board.
14. Place of Performance, Jurisdiction, Applicable Law, and Contract Language
14.1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Statutory consumer protection provisions of the Customer’s country of residence remain unaffected.
14.2. If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is the Seller’s registered office.
